These Terms of Use set out the rules under which Northgate Hub Cargo Insurance Services, Inc. (“Northgate Hub,” “we,” “us”) provides this website and the online services connected to it. By visiting or using northgatehub.com you agree to be bound by them. Please read them before going further.

Accepting these Terms

Every time you access this site you agree to comply with these Terms of Use and with our Privacy Policy, and you accept that both are legally binding on you.

Site content is not an insurance contract

The information on this site (summaries of cover, the savings calculator, worked examples for ceramics shops or bike dealers, and so on) is general in nature. Nothing here is a quotation, a binder, a certificate, or an offer of insurance. Cover comes into existence only after underwriting is complete, and it is governed solely by the wording, conditions, exclusions, and endorsements of the policy issued to you.

Intellectual property

All text, graphics, logos, icons, photographs, audio and video material, data compilations, and software on this site are owned by Northgate Hub or its licensors and protected by copyright and other intellectual-property laws.

This material is made available for your information only. Except for viewing it for your own non-commercial use, or as otherwise permitted by law, you may not reproduce, distribute, modify, or reuse any of it without our prior written consent.

Acceptable use

When you use this site you agree that you will not:

Your responsibilities as a policyholder

If you purchase or bind cover through Northgate Hub, you agree to:

1. Follow the coverage rules: the conditions, limits, exclusions, and documentation requirements set out at enrollment, in your policy documents, in program guidelines, and in the claims process.
2. Read your policy: you are responsible for reviewing the terms that apply to your goods, routes, commodities, and trading activity.
3. Stay current: coverage rules and program guidelines can change. We notify you of material changes on this site, through your broker, by email, or via the other contact details we hold for you.
4. Tell us what changes: let us know promptly about changes to your shipping profile, values, commodities, or anything else that may affect cover or premium.
5. Use the claims process: submit claims with the required documentation within the stated deadlines. Missing steps may affect the outcome of a claim.

Our commitments to you

As your cargo and shipping insurer, Northgate Hub in turn agrees to:

1. Comply with the law: conducting our business in accordance with applicable insurance laws and regulations, including fair claims handling and required record keeping.
2. Protect your information: maintaining reasonable safeguards against unauthorized access, alteration, loss, or disclosure of client data, as described in our Privacy Policy.
3. Keep records responsibly: retaining records for the periods required by law and industry practice, and deleting or anonymizing them when they are no longer needed.
4. Explain things plainly: providing plain-language information about our programs, the material terms of cover, the claims process, and any changes that could affect your policy, wherever practicable.

Third-party websites and tools

This site may link to websites and tools operated by third parties, including carriers and partner platforms. We do not control their content, their privacy practices, their security, or their uptime, and your use of them is subject to their own terms.

Disclaimer of warranties

This site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and we do not guarantee that the site will operate uninterrupted or error-free, or that it will be free of viruses or other harmful components.

Limitation of liability

To the extent permitted by law, Northgate Hub and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this website. For direct damages connected with your use of the site, our total liability will not exceed the greater of the amount you paid us for online services in the twelve months preceding the claim or one hundred U.S. dollars, except where the law prohibits such a limitation.

Indemnification

You agree to indemnify and hold Northgate Hub harmless from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or your misuse of the site, except to the extent caused by our own gross negligence or willful misconduct.
